What
Is the Saskatchewan Human Rights Tribunal?
The
Human Rights Tribunal is an independent, quasi-judicial provincial
body that adjudicates human rights complaints under the Saskatchewan
Human Rights Code.
The
Tribunal consists of a Chair, supported by appointed Members.
What is the Tribunal's Mandate?.
The
Tribunal conducts public hearings of complaints that have been referred
to it by the Saskatchewan Human Rights Commission and reviews dismissed
complaints at the request of a Complainant. Discrimination complaints
may be based on race, colour, age, sex, sexual orientation, physical
or mental disability, religion, marital status, family status, place
of origin or ancestry. The Human Rights Code covers discrimination
in a variety of contexts, including tenancy, employment, employment
advertisements, publications, public services and facilities, purchase
of property and discrimination by unions or associations.
At
a Tribunal hearing, the parties have an opportunity to present evidence
to support their case. Hearings are open to the general public.
The Tribunal issues a decision, with reasons. The Tribunal does
not comment publicly on its decisions nor does it issue Press Releases.
Once
a case has been referred to the Tribunal by the Commission, the
Code requires that the Tribunal hold a hearing unless the complaint
settles or is withdrawn by the complainant.
What Is the Difference Between the Saskatchewan Human Rights Tribunal
and the Saskatchewan Human Rights Commission?
The
Human Rights Tribunal is completely independent of the Human Rights
Commission. The two bodies have separate mandates and separate administrative
processes. The Commission receives and investigates complaints and,
in some cases, refers a complaint to the Human Rights Tribunal,
which then conducts a hearing. The Tribunal only adjudicates complaints
that have been referred to it by the Commission after an investigation
or reviews a complaint dismissed by the Commission.
